If you have paid by credit card, we will charge your card on file for the remaining balance 30 days prior to arrival. If you wish to make other payment arrangements, you will be required to contact us no later than 45 days prior to {ArrivalDate} . If you prefer to pay your balance by E-Check, please Contact us.

This rental agreement must be received prior to arrival.

GUESTS MAKING A RESERVATION MUST BE AT LEAST 25 YEARS OLD and by submitting their reservation they are confirming that they are at least 25 years old or older. If there is a party planned at the property you will be asked to leave without a refund of any fees. Without Prior Authorization.

General Information: The following is the Vacation Rental Agreement between Kathy Nixon dba: Paradise Island, LLC (referred to as "we" or "us") and you which needs to be followed in order for you, your guests and others who come after you, to enjoy their stay at the property being rented (the "Property").

Failure to follow any procedures or directions in this agreement could result in additional charges.

AGENCY DISCLOSURE – Kathy Nixon serves as the Owner, Manager & representative of these vacation properties in its rental program, and is acting at all times, in and for the best interests of the owner.

We provide linens, cookware, pillows, and a washer and dryer. YOU WILL NEED TO BRING: food, personal items, toilet paper, paper towels, towels for your boat, aluminum foil for the grill, soaps and shampoos, laundry detergent, garbage bags and any special items you require to have a good time.

There are to be NO HOUSE PARTIES (without Prior Authorization) and NO more than the allotted number of people may occupy the Property at any time, unless you have a small infant with a crib and it has been pre-approved by us. Anyone breaking these rules will be evicted without a return of any deposits or monies collected regardless of how long you have been at the Property. A house party is defined as occupancy by more than the stated allowable tenants and/or unruly or other objectionable behavior carried on at the Property.

Reservations: You can make a reservation by Booking online on our web page, by calling

865-585-5865 or by emailing us at knix9967@gmail.com. This Vacation Rental Agreement will be sent to you via email. The original copy of this agreement must be digitally signed online. You may make payments by credit card (Visa, Master Card, Discover and American Express). I link will be provided after signing.

Final Payment: Once we have received your Initial Payment and the signed Vacation Rental Agreement, we will send you a receipt for your payment, which will also serve as a confirmation of your reservation. The balance due will be indicated on this form. Such balance will consist of the remaining half of the rent, the processing fee, the cleaning fee and the taxes (currently 12.25% for Claiborne County). Sales and Use Taxes are out of our control and subject to change without notice prior to final payment. The entire balance must be received no later than 30 days prior to your arrival date in order to retain your reservation. See the rules for cancelation, as they also apply here. The policy for method of payment is the same as for the Initial Payment. Please mark your calendar. We will send a reminder to you 5 days prior to payment due date. We will send you a final receipt after we receive your final payment along with directions to your rental unit 7 days prior to arrival. If you need to make changes to your initial payment method, please contact us 31 days prior to arrival or sooner.

Recent Reservations: If you are making a reservation less than 30 days prior to check-in, you will be required to pay the entire balance when making the reservation. We will only accept credit cards for "recent" reservations.

Cancelations:

(a)30 or Fewer Days. If you cancel your reservation sixty (60) or fewer days prior to your scheduled arrival date, please do so in writing. We will immediately put the Property back on the market for rent. If we successfully rent the Property for the entire period you reserved, we will refund your money less a $100.00 cancelation fee. If we are unable to rent the Property, your payment will be forfeited. [In the event that we are able to rent the Property for a portion, but not all, of the period you reserved, we will refund an amount which equals the payment you have made to us multiplied by a fraction (i) the numerator of which shall be the number of days during your scheduled period which we were able to rent and (ii) the denominator of which shall be the total number of days you reserved the Property. A cancelation fee shall then be deducted from such amount. For example, if you reserved the Property for 10 days and, after you canceled your reservation, we were able to successfully rent the Property for three of those ten days, we would refund 30% of the amount you have paid less a $100.00 cancelation fee.]

(b)More than 60 Days: If you cancel your reservation more than sixty (60) days prior to your scheduled arrival date, please also do so in writing. We will refund your money.

CANCELATION AND REFUNDS:

Cancelation of booking at any time after Confirmation has been issued may result in forfeiture of deposit(s). Cancelation within the 30-day period prior to check-in may result in forfeiture of the entire rental amount. Refund of monies paid for rental and services will be made under the following circumstances: (1) If, on the day that the rental is scheduled to begin, the property is unfit for habitation and no equivalent substitute can be obtained, or the property is not reachable by the usual means of transportation, or access to the property by visitors has been prohibited by authorities; or (2) The Villa is re-booked for the same time period and at the same rate of initial booking. If a portion of the rental time is re-booked, a pro-rata refund will be made. All refunds, whether in whole or pro-rata, will be subject to the deduction equal to 15% of deposit(s) paid. To protect against cancelations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase trip cancelation and Interruption Protection insurance to assure refund of deposits paid and reimbursement of other vacation payments. Such insurance is available through our website, travel agents, auto clubs such as AAA, or online at http://www.csa.com/

CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS:

If a catastrophe (hurricane, tornado, earthquake, flood, etc.) or any situation simply beyond our control impairs the vacation rental, Kathy Nixon is not responsible for finding alternate lodging for the renter or for the renter`s financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. Whether you own property, run a business, or rent a cabin on Norris Lake, the threat of a snow, flood, or fire is always present during certain months of the year, and we all assume this risk. Therefore, we suggest you consider Travel Protection Insurance to secure your vacation investment and eliminate your financial risk. There will be no refunds of any kind for evacuations.

RESERVATION CHANGE FEE - All reservations that need date and/or property changes are subject to a non-refundable $30.00 rescheduling fee per change. All changes must be done prior to cancelation period expiration. You must make changes Sixty (60) days or more prior to your arrival date. Agent may review cancelations that are done 59 days or less and at the Agent(s) own discretion may approve a rescheduling with an administration fee at a rate of 50% of the advance payment. Please note: Any reservations that where approved for rescheduling after cancelation period had expired, cannot cancel. If so, Guest(s) forfeit all deposits. There is no guarantee that the Guest will receive approval so do not expect it!

NO SHOW POLICY - The total amount of the reservation will be charged along with a $30.00 administration fee.

CUSTOMER SERVICE - after your reservation has been made, if you have any questions, we will be pleased to answer them for you on our customer service number 865-585-5865.

Processing Fee: You will be charged a non-refundable fee of 5 % of your rental total to cover fees related to your reservation. Such processing fee shall be due as part of your final payment.

Cleaning Fees: You have been charged a cleaning fee according to the house size and amenities for each reservation. Such fee will be due as part of your final payment. If the home is left in a very dirty condition, there will be an additional cleaning charged to your credit card on file. So please follow check out instructions posted on the refrigerator.

Property Protection (PPF) – NON REFUNDABLE -

Guests acknowledge, understand, and agree that the moment Guests give Agents their credit card information, Agents are authorized to charge said credit card for the rental amount agreed upon including any addition room fees, cleaning fees, lodging tax. A $59.00-79.00 Property Protection is applied to all reservations. Starting price is generally based on 4 guests/2 bedrooms, read individual cabin amenities for pricing. Cancelation Policy will govern any cancelation, rescheduling, or change after the credit card authorization.

GUESTS MAKING A RESERVATION MUST BE AT LEAST 25 YEARS OLD and by submitting their reservation they are confirming that they 25 years old or older. Property protections does not cover parties of any kind. You will be responsible for damages caused from excessive use or if a party occurred.

All reservations require guests to purchase a $59-$79 Property Protection which covers unintentional damages of up to $1,500.00 to the rental unit interior, exterior or surrounding property that may occur during your stay. Damages must be reported to Kathy Nixon prior to check-out. Any intentional or unintentional damages that exceed $1,500.00 will be charged to the credit card on file. Property Protection does not cover damages that are done with full intention to cause damage to the property or a result of gross negligence or replacement costs for theft by you or your guests. Parties are not included in Property Protection. Any non-covered repairs or replacement costs will be charged directly to the Guest credit card on file.

What is the Property Protection Fee & how does it work? Each reservation is charged a non-refundable fee of $59.00-79.00 for a Property Protection. This Protection intended to protect you from charges due to accidental damage only. The PPF can provide up to $1,500.00 to repair accidental damages (beyond normal wear and tear). If any damages surpass $1,500.00, additional charges will be applied to the credit card on file and written documentation will be sent to the Guest(s) of record. If damages are determined to be caused by the willful misconduct, misuse, or pets; the PPF will be voided on the grounds of intentional act(s), gross negligence, willful and wanton conduct by Guest(s) or Licensee of Guest(s), or visitor. These occurrences will result in the Guest(s) credit card on file being charged in full for any damages and management fees. The PPF does not cover any additional management fees or fines. All accidental damage must be reported to Paradise Island, LLC office before guest departure to qualify for protection.

If I accidentally break something am I automatically covered by the Damage Protection Fee (PPF)? No, A guest MUST REPORT any damage at the property during their stay to qualify for full coverage. If damage is discovered by our Property Care team after departure the PPF can be denied. Please report any damage if it occurs. If it is denied, then the guest will be responsible for any damage charges.

Check-in Procedures: You will be given directions to the rental unit where you will check in 1 day prior to arrival via email provided we have received this document signed.. Please call (865) 585-5865 for your digital lock code was not already sent. If you arrive early without prior authorization you will not be able to enter if the cleaning crew is still at the Property. You may enter the Property no earlier than 5:00 P.M. on the scheduled date of arrival. Upon arrival at the Property, report any damages that day to our office. Call 865-585-5865 opt.6 to avoid any charges for damages not incurred by your group. Please leave a message.

Cleaning: Upon your arrival, notify us immediately if you do not find the Property in clean condition. If we do not hear from you within 1 hour after on the scheduled date of arrival, we will assume you found the accommodations in an acceptable condition.

Checkout Procedures:

CHECK OUT TIME IS 10:00 A.M. on the scheduled date of departure, NO EXCEPTIONS. If you are still on the Property when the cleaning crew arrives, you will be asked to leave if after 10a.m. If you do not depart, you will be charged an additional day`s rental fee.

Checkout Duties: Before checking out, PLEASE:

Wash and dry all dishes, cookware, utensils, etc. and put such items in the proper places.

Remove all food from refrigerator.

Return all furniture to original location.

Put all trash in plastic bags and place in trash container.

Check closets, dressers, and under beds for personal belongings. We are not responsible for any lost or stolen items. When requested by you, items turned in by housekeeping will be returned COD with a $25.00 shipping fee.

Items which are unclaimed after thirty (30) days shall be donated to charity.

Turn off all lights.

Return all keys and report any damages or maintenance needs.

Strip beds that were used and put all dirty sheets and towels by the washing machine. Do not put comforters, Mattress pads or bed spreads with dirty or wet linens.

Please start a load of towels.

PET POLICY:

Guests with dogs are asked to please respect the comfort and safety of other guests, both during and after your stay. For this reason, we ask that you please follow these guidelines during your time with us:

•Please clean up after your dog, both in public areas and in the yard of your rental property. •Please do not allow your dog to bark excessively or to roam onto neighboring properties Complaints may lead to eviction without refund.

•Please do not allow dogs on furniture or beds. It is also helpful to bring something (bed, blanket, etc.) on which you know your pet will be comfortable sleeping. Just because you allow your pets on your furniture and beds at your home does not mean it is allowed in our rental properties. Extra cleaning fees will be charged for furniture, blankets, comforters, etc. that have pet hair left behind.

•Please groom your dog, particularly if it is a breed prone to shedding. Pet hair can be difficult to remove, and the next renter in your property may not have a pet. Extra cleaning fees will be charged for furniture, blankets, comforters, etc. that have pet hair left behind.

•Please don’t leave your dog unattended for long periods of time. A crate is ideal for those situations in which you must leave. You are responsible for any damages your pet causes.

•Please do your best to clean and dry your dog after a walk or swim; this will help to ensure you will leave the property in good condition without being charged an extra cleaning fee.

•Please do not allow dogs in swimming pools or hot tubs.

•Please ensure that your dog’s medications and immunizations are up-to-date, especially flea treatment.

Non-Refundable Pet Fee:

•A $100.00 non-refundable “Pet Fee” ($175 for two dogs) will apply to each reservation that includes a dog. (This fee does not cover damage to the property or grounds resulting from a dog, including but not limited to chewing, scratching, digging and unreported house training accidents or the additional clean up inside and out after your pet).

•Pet friendly properties accept dogs weighing under 45 pounds and at least one (1) year old, with a maximum of two (2) dogs per property. “Visiting” pets are not allowed.

•No Cats Allowed unless specifically requested and approved by the property owner.

CAUTION: Please be aware that there are black widow spiders, copperhead & rattlesnakes in the area.

HOMES ~ FURNISHINGS ~ EQUIPMENT ~ ETC. - All homes are privately owned properties furnished and equipped by its OWNER. As such, Agent(s) cannot make any changes to the furnishings or equipment provided by the owner. If Guest(s) requires special appliances or equipment, please bring them with you. Decor, style, and color will vary. Furnishings are subject to change without notice. Under no circumstances are furniture, bedding, mattress pads, utensils or any other property supplied with the rental property to be taken out or transferred from one property to another (will result in a charge against Guest(s) credit card). Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to Guest(s), the renter, or to your Damage protection on the damage observed. Certain areas in each rental property are locked for the OWNERS personal storage and are not included in this rental. IF the owners closets are broken into, you will be charged for any missing items or to door lock..

LINEN - A basic supply of linen is provided in each property. Bed linen and bath towels are not changed during your stay. The startup set of toilet tissue, paper towels and trash bags are not replenished.

Rates - Rates for weekly stays are shown on our website at ParadiseIsland.holidayfuture.com and are based upon the homes occupancy. Rates for holidays, special events, and weekends may be higher. Rates do not include taxes and are subject to change. All of our properties can be rented with a two-night minimum during Mid & Off Season. Lakefront properties have a 7 night minimum during the peak Season & a 3 night minimum for Holidays. Lakeview properties have a 3 night minimum requirement for holidays & Peak Season.

DOUBLE BOOKINGS - Double bookings are rare. In the event that Guest(s) reservation for the rental property overlaps or matches the reservation of another tenant, Agent(s) reserves the right to relocate Guest(s) to a different rental property within the Agent`s rental program or that of another company. Every effort will be made to ensure that the replacement property is reasonably comparable to the original rental property booked. Agent(s) shall have the sole right to select such replacement rental property. Agent agrees to pay any additional charges due in excess of the rental amount for the rental property, and refund any amounts paid by Guest(s) in excess of the replacement property rental amount. Guest(s) will have the option to (1) accept the replacement property or (2) reject the replacement property and receive a refund of all rents and fees paid for the rental property. Guest(s) agree that Guest(s) choice between these alternatives will be Guest(s) sole remedy for any and all damages, liability, or inconvenience arising out of the double booking.

REPAIRS ~ SERVICE CALLS~ REFUNDS - Agent(s) cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TVs, Satellite Receivers, VCRs, or other appliances. Please report any inoperative equipment to our office immediately. Agent will make every reasonable effort to have repairs done quickly and efficiently or move Guest(s) to a different property if possible. Should a repair person make a call to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be the Guest(s) responsibility. No refunds or rent reductions will be made due to failure of appliances or equipment. All maintenance requests must be reported to the office between 9 AM and 5 PM. Please leave a message if after hours and we will respond as quickly as possible. Guest(s) understands and agrees that Agent(s) may enter the rental property at any time for the purpose of making needed repairs. Please keep in mind that the property has been reserved and held for you and that others may have been turned away. Construction of new accommodations and attractions does occur in resort areas. Refunds or rate adjustments are not made for any inconvenience due to construction, road repair, etc. Please DO NOT asks for refunds. ~ No refunds for early departures (less days than reserved) ~ No refunds will be given for delayed arrival ~ No refunds for reducing the number of nights reserved with less than 7 days notice ~ No refunds or reschedules due to inclement weather.

TERMINATION BY OWNER/SUBSTITUTIONS - Agent(s) strives to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances, Agent(s) cannot absolutely guarantee a specific rental property. Agent(s) reserve the right to change assignments without notice or liability should the unit or property become unavailable. When comparable accommodations are not available, Guest(s) will have the option of selecting from available properties at the published rate or receiving a complete refund of their reservation deposit. Where there is no advanced deposit, no substitution can be made, Agent(s) will attempt to give as much notice as possible so other arrangements can be made.

VACATION HOME UNDER CONSTRUCTION - If Guest(s) have selected a property,

which is under construction, and the property is not completed prior to Guest(s) Arrival Date, Agent(s) will use its commercially reasonable efforts to arrange for comparable accommodations at similar rents. If comparable accommodations at similar rents are not available, neither Agent(s) nor Owner will be liable to Guest(s) beyond the obligation to refund to Guest(s) all payments made by Guest(s).

ACTS OF GOD/CONSTRUCTION NOISE - Neither Owner nor Agent(s) shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. NO REBATE OR REFUND will be offered in these circumstances.

RIGHT OF ENTRY - Guest(s) agree that the Agent(s) reserves the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Agent(s) may deem appropriate, or to show property to prospective purchasers or guests.

EXPEDITED EVICTION - A material breach of this Agreement by Guest(s), which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained here in will result in

IMMEDIATE EVICTION and forfeiture of rent and security deposit. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply. Guest(s) may be evicted under such procedures if Guest(s): (i) hold over in possession after Guest(s) tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (iii) fail to pay rent as required by this Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.

LIMITATION OF LIABILITY:

Under no circumstances shall Paradise Island, LLC or Property owners, be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Paradise Island, LLC or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Paradise Island, LLC, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Paradise Island, LLC will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, boating, golfing, swimming, boogie boarding, surfing, hiking, biking and mountain climbing. This list is not all-inclusive, but indicates some of the hazards of vacationing on Norris Lake. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), precipitous drop-offs on lake floor, unfenced pools, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this home, you acknowledge that in all events and circumstances, Paradise Island, LLC, its officers and employees shall not be liable. Paradise Island, LLC reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Home Owners Association House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

SATELLITE/CABLE TELEVISION - All properties are privately owned and have different subscription packages for cable and/or satellite. Agent(s) does not guarantee any programs or events, Guest(s) liable for ordering any pay per view, programming charge

plus an additional $5.00 charge per program or event will be charged to the guest (s) credit card.

PHONE CALLS – Not all properties are equipped with a telephone; Guests agree to make all long distance calls with a calling card. If Guest(s) charges long distance phone calls to Owner`s phone, Guest(s) will be liable for said charges plus a charge of $5.00 per call.

SMOKING - Smoking is not permitted inside any of the Norris Lake Cabin Rental Properties. Outside smoking is permitted but PLEASE DO NOT LITER. Use ash tray and do not through on ground as fire may erupt. Failure to obey this rule will result in an additional cleaning fee charged to the guest(s) credit card or at the very worst the guest will be responsible for damages incurred from fire.

VIOLATING AGREEMENT- If Guest(s) violates any of the conditions of this Agreement; Agent(s) may terminate this Agreement and enter Premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents.

FIREWORKS: FIREWORKS ARE ABSOLUTELY PROHIBITED WITHIN ALL RESORT AREAS. NO EXCEPTIONS! You will be ejected from the home without reimbursement of any kind if reported letting off fireworks.

Fires: There are to be no bon fires outside of fire rings due to TVA regulations. There is a maximum of 5 years in prison and a $50,000 fine involved if the TVA discovers such activity. Be safe and do not start any fires.

NOTICE OF ABSENCE:

You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES:

If you stay in the unit, without written permission, after the Rental Agreement has ended, you will be a holdover tenant and may be liable for twice rent under the Rental Agreement on a prorated daily basis for each day you are a holdover tenant. If you leave any personal property, which we determine to be of value, we must contact you by mailing a notice. After 20 days, if you do not respond, we may advertise the items for sale or donate them to a charitable organization. If we have to give any notice to you, we can serve it to any occupant. By serving one of you, we have given notice to all of you. If we cannot deliver a notice to you, we may post the notice in a conspicuous place in or on the unit.

INSURANCE:

You understand that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance

covering all of your personal property located in the unit or bear full responsibility for its damage including damage from fire, water, theft, or any cause.

CHANGES TO A BOOKING:

An additional $30.00 administrative fee will be charged by Paradise Island, LLC for any change to a booking after a Confirmation has been issued. Acceptance of any change is subject to approval by Paradise Island, LLC.

ACKNOWLEDGEMENT:
